1. Acceptance of terms

By accessing or using TinyTune ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of service

TinyTune provides a platform for fine-tuning large language models (LLMs) using your own data. The Service allows you to upload datasets, select base models, and download fine-tuned models for your own use.

3. Account registration

To use the Service, you must create an account using one of our supported authentication providers (GitHub, Google, or HuggingFace). You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Credits and payments

The Service operates on a credit-based system:

• Credits are purchased as one-time payments and do not expire
• Credits are non-refundable once used for fine-tuning jobs
• Unused credits may be refunded within 14 days of purchase if no fine-tuning jobs have been started
• Prices are subject to change, but purchased credits will retain their value

5. Acceptable use

You agree not to use the Service to:

• Upload or process any illegal, harmful, or offensive content
• Create models designed to generate harmful, deceptive, or illegal content
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your content and data

Ownership: You retain all rights to your training data and the fine-tuned models created from it. TinyTune does not claim any ownership over your content.

License: By uploading data to the Service, you grant us a limited license to process your data solely for the purpose of providing the fine-tuning service.

Responsibility: You are responsible for ensuring you have the right to use any data you upload and that it does not violate any third-party rights.

7. Fine-tuned models

Fine-tuned models created through the Service are yours to use, including for commercial purposes. However:

• You must comply with the license terms of the base model you selected
• You are responsible for how you use and deploy your fine-tuned models
• Models are available for download for 90 days after job completion

8. Service availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance that temporarily affects availability
• Modify or discontinue features with reasonable notice
• Experience downtime due to factors beyond our control

9. Limitation of liability

To the maximum extent permitted by law, TinyTune shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Any issues arising from your use of fine-tuned models

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will meet your specific requirements
• Fine-tuned models will achieve any particular performance level
• The Service will be error-free or uninterrupted

11. Indemnification

You agree to indemnify and hold harmless TinyTune and its affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your fine-tuned models and how they are used

12. Termination

You may terminate your account at any time. We may terminate or suspend your account if you violate these Terms. Upon termination:

• Your right to use the Service will cease immediately
• Unused credits are non-refundable unless required by law
• We may delete your data in accordance with our Privacy Policy

13. Changes to terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TinyTune operates, without regard to conflict of law principles.
